What is EB-3 Immigrant Visa?
The EB-3 Immigrant Visa is a permanent residence U.S. Visa (or Green Card) given to skilled, professional or other workers.
What is EB-3 Visa?
The EB-3 Immigrant Visa stands for Third Preference Employment-Based (EB) green card, thus called EB-3. Like other Green Cards, it grants the visa holder permanent residency to live and work in the United States.
To be eligible, you must belong to either of the following subcategories:
- “Skilled workers” – individuals whose jobs require a minimum of 2 years’ full-time training or experience. The skilled worker must meet the educational, training or experience requirements of the job opportunity. Any relevant post-secondary education may be considered as training.
- “Professionals” – individuals whose job requires at least a U.S. baccalaureate or foreign equivalent degree and are a member of the professions.
- “Other workers” – individuals performing unskilled labor requiring less than 2 years’ full-time training, education or experience.
Eligibility Criteria
Can I bring my family as an EB-3 Immigrant Visa holder?
If your I-140 petition is approved, your legal spouse may come to the U.S. via either E34 (spouse of a “Skilled worker” or “Professional”) or EW4 (spouse of an “Other worker”) visas. Minor children under 21 and unmarried are typically accepted through E35 (child of a “Skilled worker” or “Professional”) or EW5 (child of an “Other worker”).
The legal spouse may apply for an Employment Authorization Document (EAD), which lets them work freely in the country, during the process of your permanent residency application.
EB-3 Visa Requirements
EB-3 visa requirements have lower standards than other Green Cards, such as the EB-2. Hence, there is a higher chance to qualify for this immigrant visa. However, there is often a waiting list for approval.
Most EB-3 visa applications cannot be adjusted from temporary (non-immigrant) visas until the petitioner’s priority date becomes current. This date is set when the Labor Certification Process begins.
Application Process
Your employer (petitioner) will perform the following as part of the application process:
- File a form I-140 with the U.S. Citizenship and Immigration Services (USCIS);
- Establish that they can afford the offered position upon granting of the Green Card; and
- Prove that the beneficiary meets the necessary requirements.
